“Accessibility Requirements” means any accessibility requirements of a Purchaser and/or their Guest(s), including but not limited to (i) easy access to particular seats and/or facilities due to mobility impairments; and (ii) the need for a person to accompany the Purchaser to support their accessibility requirements;
“Adult Ticket” means a General Admission Ticket for a Ticket Holder aged 17 and over on the Match Day or Event;
“Age Restricted Ticket” means any ticket that has a restriction or entitlement on the basis of the age of the Ticket Holder. This can include (without limitation) tickets for ‘Under 17’s’, ‘Junior Tickets’, ‘Senior Tickets’;
“App” means one or more of the following:
“Ashes” means the fourth Ashes Test Match scheduled to be played on the Match Day;
“Commercial Partner” means any official partner of the Owner which has been granted “official partner” status pursuant to a commercial association with the Owner from time to time;
“County Matches” means any one or more of the following schedules to be played at the Venue where the home team at the Venue shall be Hampshire:
“Designated Ticket Office” means the ticket office designated at the Venue;
“ECB” means the England and Wales Cricket Board Limited;
“ECB Anti-Discrimination Code” means the ECB’s Anti-Discrimination Code, as updated from time to time;
“Essential Companion” means a person who is responsible for a Ticket Holder’s care to whom a Ticket may be transferred in accordance with Clause 3.3(c) or Clause 3.3(d);
“Event” means any event hosted at the Venue, that is not a Match Day, including (without limitation) concerts and shows.
“Full View Ticket” means a seat from which the Ticket Holder has a clear view of both ends of the wicket, the bowlers’ run-ups and at least one replay screen, and from which at least 80% of the outfield is visible;
“General Admission Ticket” means an electronic ticket for admittance to the Venue and/or (as applicable) a numbered and reserved seat in a public stand at the Venue for the Purchaser and, if applicable, their Guest(s);
“Ground Regulations” means those ground regulations of the Owner and/or the Venue from time to time, which are available to view at https://www.utilitabowl.com/cricket/ground-regulations/;
“Guest” means any person the Purchaser invites to attend the Match Day and/or Event to whom a Ticket may be transferred in accordance with Clause 3.2 (Transfer of Tickets);
“Hospitality Experience” means any one (or more) of the following: premium, ticketed Match Day or Event package providing (without limitation) exclusive access to private suites (boxes), shared dining facilities, drinks package(s), food, complimentary bars, and/or dedicated seating;
“Hospitality Ticket Portion Price” means the price of a gold admission ticket price for the respective Match Day. For the avoidance of doubt, no refund shall be made on the purchase price paid by the Purchaser for the Hospitality Experience as a whole.
“ICC” means the International Cricket Council, the world-wide governing body of cricket;
“IT20” means any international (men’s and/or women’s) T-20 match scheduled to be played at the Venue.
“Junior Ticket” means a General Admission Ticket for a Ticket Holder who must be under the age of 17 on the Match Day and/or Event;
“Match Day” means any day of the dates shown on the Platform for
which have been scheduled to be played at the Venue, for which a Ticket Holder has been successful in purchasing a Ticket(s) or is in possession of a Ticket(s) (howsoever arising) but at all times subject to the Terms and Conditions;
“Membership” means the status granted by the Owner to an individual whose application for membership has been accepted by the Owner and whose applicable membership fee has been paid, entitling that individual to the rights and benefits associated with the relevant category of membership, subject to these Terms & Conditions and any other terms, conditions or restrictions applicable to that membership
“ODI” means any international (men’s and/or women’s) one-day (50 over) match scheduled to be played at the Venue
“Owner” means Hampshire Stadium Limited, a company incorporated in England and Wales with Company Registration Number 04343355, and having its registered address at Utilita Bowl Botley Road, West End, Southampton, England, SO30 3XH;
“Parking Pass” means a car parking pass, permit, or other parking credential issued to a person who purchases, receives or is otherwise issued with the right to use a car parking facility at the Venue.
“person” means and shall be deemed to include any individual, company, corporation or other entity;
“Platform” means the Owner’s ticket platform at: (i) http://tickets.utilitabowl.com or (ii) http://events.utilitabowl.com or (iii) any other platform or link designated by the Owner under these Terms and Conditions from time to time;
“Purchaser” means any person purchasing a Ticket pursuant to these Terms & Conditions;
“Purchasers Account” means the Purchaser’s online account maintained with the Platform on which the Ticket(s) were purchased;
“Registered Email Address” means the email address used and given by the Purchaser at or soon after the time of making the purchase;
“Replacement Tickets” means a ticket issued to the Ticket Holder at the Designated Ticket Office.
“Resale Platform” means the Owner’s ticket resale platform, accessible through the Purchaser’s Account, which shall enable Purchasers with the opportunity to resell Tickets;
“Restricted View Ticket” means a seat from which the Ticket Holder has a clear view of both ends of the wicket, the bowlers’ run-ups and at least one replay screen, and from which between 60% and 80% of the outfield is visible. A Restricted View Seat may also have one or more objects within the Ticket Holder’s field of view;
“Specific Allocated Seating Arrangement” means where:
“Terms & Conditions” means these terms and conditions;
“Test Matches” means any (men’s and/or women’s) international test match scheduled to be played at the Venue
“Ticket(s)” means an Adult Ticket, Junior Ticket, Hospitality Experience and/or Wheelchair Ticket;
“Ticket Holder” means a person who applies for, purchases, holds, transfers and/or uses a Ticket(s), as applicable, which shall include a Purchaser, Guest and/or Essential Companion;
“Unauthorised Reseller” means a reseller that is not authorised by the Owner to resell Tickets;
“Unlawful Ticket(s)” means (a) any Ticket(s) that are found or suspected to have been (i) placed for sale or (ii) purchased on any resale platform of an Unauthorised Reseller; (b) any Ticket(s) that have been sold at a higher price than their face value; (c) any Ticket Holder over the age of 17 on the Match Day and or Event using a Junior Ticket; or (d) any Ticket used for (i) a prize or competition; (ii) promotion, advertising, fundraising, auction, raffle or anything similar; or (iii) a commercial hospitality package, by any person trading for that purpose without the authorisation of the Owner in writing;
“Venue” means the Utilita Bowl, located at Botley Rd, West End, Southampton SO30 3XH;
“Website” means the Owner’s website known as http://utilitabowl.com;
“Website Terms of Use” means the terms and conditions for the use of the Website, which can be viewed here; and
“Wheelchair Ticket” means a Ticket(s) for admittance to the relevant wheelchair-accessible area/seat at the Venue.
Purchasers who have been successful in purchasing Ticket(s), shall be permitted to transfer the Ticket(s) to a Guest subject to the following conditions:
Any purchase of a Hospitality Experience which has any boxes included as part of the Hospitality Experience will be on the basis of a minimum number of 10 guests, unless otherwise agreed with the Owner in writing.
Whilst every reasonable effort will be made by the Owner to ensure that the Hospitality Experience is in accordance with the details as set out at the point of sale, the Owner reserves the right in the Owner’s absolute discretion to make any changes to the Hospitality Experience which does not in the opinion of the Owner materially affect the quality of the Hospitality Experience.
A dress code applies to the hospitality areas at the Venue and the Venue and/or the Owner has the right to refuse admission to any person (which in the reasonable opinion of the Venue and/or the Owner) wearing inappropriate items of clothing and/or footwear. Specific advice in relation to the dress code will be included in the event information section sent to the customer ahead of the Match Day and/or Event the Ticket Holder is attending.
The Owner and the Venue operates a strict ‘Challenge 25’ policy and any guests that cannot produce a legal form of identification may be refused the sale of alcohol.
Any Hospitality Experience refunds shall be limited and subject to clause 10.1(b) of these Terms and Conditions.
Any additional products, services or upgrades requested by the Ticket Holder(s)/Guests that are not included within the original Hospitality Experience must be paid for in full at the Match Day or Event using an authorised payment method, unless otherwise agreed by the Owner.
The Owner shall be entitled to have any Ticket(s) purchased cancelled in full without any liability to the Purchaser, other than pursuant to Clause 10 (Refunds), if any Purchaser:
All Tickets shall be issued electronically prior to the Match Day and or Event by the Owner as a digital ticket, which shall be delivered and sent to (one or more of the following as may be applicable):
Ticket Holders are required (to the extent applicable) to ensure that they have a smartphone device with the latest version of the App. Subject to Clause 8 (Entry and Use of Tickets at the Venue) Tickets must be presented and scanned to gain entry to the Venue.
A Ticket Holder is permitted to exit and re-enter the Venue on an Match Day or Event provided that on exit the Ticket Holder must indicate the intention to gate staff to re-enter the Venue on the Match Day and or Event and thereafter the Ticket shall be scanned on exit and rescanned on entry to the Venue to allow re-entry. The same Ticket must be used during this process. The Owner reserves the right to refuse entry to any person who attempts to re-enter the Venue without having had their Ticket correctly scanned upon leaving the Venue, or without having followed such other process for monitoring re-entry to the Venue as may be determined at the sole discretion of the Owner.
No person who is subject to a ban or suspension imposed and/or recognised by Owner, the ICC, the ECB or any other ICC Member as a result of a breach of any applicable the Owner’s, ICC, ECB or other ICC Member rules, regulations, codes or directives shall be permitted to enter the Venue and any such person found within the Venue on the Match Day and or Event shall be liable to immediate removal from the Venue.
The Owner will not be liable for any failure (whether complete or partial) or delay in relation to the performance of its obligations under these Terms & Conditions where the failure or delay arises from an event beyond its control including (without limitation) acts of God, inclement weather, war, fire, flood, natural disasters, government prohibition, the Owner reserves the right to cancel any Ticket without notice. In such cases, the Purchaser may be entitled to a refund for the price of the Ticket.
Unless otherwise agreed by the Owner, a Purchaser is unable to return a Ticket for any Match Day and or Event to the Owner and is encouraged to use the Resale Platform if they can no longer attend the Match Day and or Event.
The Owner reserves the right to make amendments to these Terms & Conditions from time to time. Any amendments enacted hereto shall be made available as soon as practicable on the Website.
These Terms & Conditions shall not affect a Ticket Holder's statutory rights as a consumer.
No failure or delay by the Owner to exercise any right (in whole or in part) under these Terms & Conditions shall constitute a waiver of that right, nor restrict any further exercise of that right. To the extent that the Owner is prevented or delayed by matters beyond its reasonable control from performing any of its obligation(s) under these Terms & Conditions, the Owner shall be relieved of any liability to any Ticket Holder for failure to perform or for delay in performing any such obligation(s).
No third party shall have the right to enforce any of these Terms & Conditions under the Contracts (Rights of Third Parties) Act 1999. However, it is agreed and acknowledged that on account of Clause 2(f) and Clause 3.2 (Transfer of Tickets), the Owner shall have the benefit of and be entitled to enforce all the provisions of these Terms & Conditions against Guests notwithstanding that they may not be a party hereto.
The Ticket Holder irrevocably and unconditionally consents to the collection, use and insertion into a database by or on behalf of the Owner of any personal information provided by the Purchaser and any other Ticket Holder in accordance with Data Protection Legislation for the purposes of implementation of these Terms & Conditions, including for administration, communication, enforcement and access control purposes. The Owner shall process any personal information of any Ticket Holder in accordance with Privacy Notice which may be viewed at http://utilitabowl.com/privacy.
Each of the provisions set out in these Terms & Conditions shall be severally enforceable. Notwithstanding that the whole or any part of any provision(s) of these Terms & Conditions may be declared void, ineffective or unenforceable in any respect by any competent court in any jurisdiction, the provision(s) in question (or part thereof, as the case may be) shall be severed to the extent necessary and the other provision(s) of these Terms & Conditions and the remainder of the provision(s) in question (as applicable) shall continue in full force and effect.
The Ticket Holder shall not use, alter, copy or otherwise deal with any of the symbols, trade marks, logos and/or intellectual property appearing on a Ticket, and shall not purport or attempt to create any Ticket-related intellectual property rights.
